2026 Austin Studio Tour Group Exhibition Agreement & Liability Waiver

By submitting artwork to the 2026 Austin Studio Tour Group Exhibition hosted by Almost Real Things LLC ("ART") at the ART Gallery at Canopy (916 Springdale Rd, Bldg 2 #101, Austin, TX 78702), I (the "Artist") agree to the following terms and conditions:

  1. Assumption of Risk & Release of Liability
    I understand that while ART will exercise reasonable care in handling and displaying my artwork, my participation is entirely at my own risk. I hereby release, indemnify, and hold harmless ART, TOPO, Canopy, and their respective directors, employees, volunteers, and agents from any and all liability, claims, or damages arising from loss, theft, vandalism, fire, water damage, or accidental damage to my artwork while in their possession, during transit, or while on display during the exhibition.
  2. Insurance
    I acknowledge that ART's commercial insurance policies do not provide property coverage for individual artists' submitted works. If I wish to insure my artwork against loss or damage, it is my sole responsibility to secure my own coverage. Artists are encouraged to consult their own business, homeowner's, or renter's insurance policies regarding coverage for artwork off-premises.
  3. Sales, Commission & Taxes
    I authorize ART to sell my submitted artwork during the exhibition at the mandatory, fixed pre-tax price of $150.00. I agree to a 70/30 commission split based strictly on this $150.00 base price (excluding any collected sales tax). I will receive $105.00 (70%), and ART will retain $45.00 (30%) to cover exhibition and processing costs. ART will separately collect and remit all applicable state sales taxes. I acknowledge that this is a "takeaway" exhibition; buyers will take possession of the artwork immediately upon purchase.
  4. Exhibition Requirements & Right of Refusal
    I agree to adhere strictly to the 2" x 4" size limitation and orientation requirements. I must install my own hanging hardware if using a custom substrate. ART reserves the right, in its sole discretion, to reject or remove any artwork that does not meet the size specifications, arrives damaged, is deemed unsafe for public display, or fails to include a designated upward-facing orientation arrow on the back.
  5. Retrieval of Unsold Artwork & Abandonment
    I agree to retrieve any unsold artwork during the designated post-exhibition pickup window. If I fail to retrieve my artwork within thirty (30) days following the close of the exhibition on November 22, 2026, the artwork will be considered legally abandoned. At that time, ownership of the artwork will transfer entirely to ART, and ART may sell, donate, or dispose of the artwork at its discretion without any further compensation to me.
  6. Promotional Use
    I grant ART a non-exclusive, royalty-free license to photograph, reproduce, and share images of my artwork for promotional, educational, and marketing purposes related to the Austin Studio Tour, ART and Almost Real Things.
